1. DELIVERY OF PURCHASED GOODS

    1.1 Deliveries are conducted exclusively within the territory of the Republic of Poland to the delivery address provided by the User.

    1.2 Dakar dispatches goods within the timeframe specified during the ordering process (the performance deadline set by Dakar), unless otherwise agreed upon for a specific item prior to contract conclusion. Delivery times are listed on individual product pages and on the order confirmation.

    1.3 If the User does not collect the goods, Dakar will request the User to fulfill the sales contract and collect the purchased items. If the User fails again to collect the ordered goods within the designated timeframe by Dakar, Dakar reserves the right to withdraw from the sales contract within an additional 14 days from the ineffective deadline due to the User's failure to fulfill the sales contract.

    1.4 If the shipment is not collected by the User due to reasons attributable to the User, Dakar may seek reimbursement from the User for the equivalent costs of returning the shipment to Dakar’s warehouse, unless it is specified that these costs are covered by Dakar.

    1.5 The User bears the delivery costs each time, except when otherwise arranged with Dakar. Delivery cost details are always available on the product page.

    1.6 The risk of accidental loss or damage to the goods transfers to the User upon receipt from the carrier. If the User employs a carrier not influenced by Dakar, the risk transfers when Dakar hands the goods over to the carrier chosen by the User.

    1.7 In the event of external damage to the package, to facilitate a smoother claims process, please draft a damage report with the courier and inform Dakar by emailing sklep@dakarmeble.pl. In cases of goods damaged during transport, subject to the conditions of point 10.6 second sentence, the User is entitled to warranty claims outlined in point 13.2 below.

  2. RETURNS - RIGHT TO WITHDRAW FROM THE CONTRACT

    2.1 The User, as either a Consumer or a Business acting with consumer rights, has the right to withdraw from the goods sale contract within 14 calendar days from the date of goods receipt without giving any reason and without incurring costs, except for the direct costs of returning the goods, which the User is obliged to bear unless specified that Dakar will cover these costs.

    2.2 Withdrawal from the contract is effected by the User issuing a declaration of withdrawal. This declaration can be submitted using a template form provided as an appendix to these Regulations, consistent with the statutory form referred to in Art. 30, Sec. 1 of the Consumer Rights Act. The declaration can be sent by postal mail or to the email address: sklep@klikmeble.pl.

    2.3 The deadline for withdrawal is met if the declaration is sent before the 14-day period from goods receipt expires. The User must return the goods immediately, but no later than 14 calendar days from the purchase date, with the deadline met by sending the goods back before it expires.

    2.4 To initiate a return, the User may contact Dakar by sending a message to sklep@klikmeble.pl. For a more efficient return process, please include the order number and return reason, although this is not mandatory. The User may also issue the withdrawal declaration in another clear way, including through the Service or Application, using provided functionalities.

    2.5 Upon withdrawal, Dakar commits to refunding the amount paid for the goods, including delivery costs, in the same method used by the User, within no later than 14 days from receiving the withdrawal declaration. If payment was made on delivery, Dakar will request the User's bank account details for refund purposes, which does not waive Dakar's obligations mentioned previously. Dakar may withhold the refund until the goods are returned, or proof of their return is provided by the User, whichever is sooner.

    2.6 Dakar is not obligated to refund additional costs if the User chose a type of delivery other than the least expensive standard delivery offered by Dakar.

    2.7 If the payment involved a discount voucher, the User will be refunded the actual money paid, and the used vouchers will be reinstated to the User’s account.

    2.8 If payment was made using a Gift Card, the refund will be processed, subject to the User’s consent, as a voucher added to the User’s account.

    2.9 The User is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functionality.

    2.10 The right of withdrawal does not apply to the User in cases of contracts:

    2.10.1 for goods made to the User's specifications or clearly personalized,

    2.10.2 for goods which are likely to deteriorate or expire rapidly,

    2.10.3 for sealed goods which are not suitable for return due to health protection or hygiene reasons if they were unsealed after delivery,

    2.10.4 for goods which after delivery become, due to their nature, inseparably mixed with other items,

    2.10.5 for the provision of services related to accommodation (other than for residential purposes), goods transport, car rental, catering, leisure activities, or cultural, sport, or entertainment events, if the contract specifies a date or period of performance.

    2.11 In cases like 2.10.5, Dakar may grant the User the right to withdraw within 10 days of contract conclusion. The provisions for withdrawing from goods contracts apply similarly to service contracts as specified in 2.10.5. Any right to such withdrawal will be clearly reserved in the service description on the website.

    2.12 In exercising the right of withdrawal, the User bears the direct costs of returning the goods unless Dakar agrees to bear them. For goods that cannot be returned by normal post due to their nature, the cost of the return shipment is comparable to the cost incurred by the User when ordering.

    2.13 Goods subject to return should be directed to Dakar’s headquarters.

    2.14 It is possible to arrange for a courier at the User's expense to collect the returned goods through our Customer Service. This is voluntary, and users should send a message containing the order number to: sklep@klikmeble.pl to initiate. The cost of the return shipment will be similar to the cost the User incurred when ordering, unless stated otherwise by Dakar.

    2.15 In cases of returns from promotional campaigns where the delivery was free, the costs of the return shipment arranged through Customer Service will be based on the courier's standard rates, unless Dakar decides to bear those costs.
